King of the Chain Ice Fishing Tournament Release of Liability

This Release of Liability ("Release") is entered into by and between the undersigned participant ("Participant"), Moonpie Outdoors, The Backyard Bar and Marina, their respective affiliates, employees, agents, volunteers, officers, directors, sponsors, partners, and associated businesses (collectively, the "Released Parties") for participation in the King of the Chain Ice Fishing Tournament ("Tournament") held on February 15, 2025 on the Chain of Lakes, Illinois. Assumption of Risk Participant acknowledges and understands that participation in the Tournament involves inherent risks, including but not limited to, ice fishing, exposure to cold temperatures, potential for injury or death resulting from falls, equipment malfunctions, weather conditions, wildlife, and other hazards associated with outdoor activities. Participant voluntarily assumes all risks associated with participation in the Tournament. Release of Liability In consideration of being permitted to participate in the Tournament, Participant hereby agrees to release, indemnify, and hold harmless the Released Parties from any and all claims, demands, liabilities, losses, damages, costs, or expenses (including attorney's fees) arising out of or in any way related to Participant's involvement in the Tournament, whether caused by the negligence or intentional acts of the Released Parties or otherwise. Waiver of Claims Participant agrees not to file any lawsuits, claims, or demands against the Released Parties for any injury, loss, or damage that may occur, whether on or off the ice, during the Tournament. This waiver applies to all claims arising from personal injury, property damage, or any other harm that may occur, even if the injury or damage was caused by the negligence or fault of the Released Parties. Indemnification Participant agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, actions, suits, or proceedings arising out of or related to the Participant's actions or omissions during the Tournament, including claims brought by any other person or entity arising from Participant's participation. Medical Emergency In the event of a medical emergency, Participant authorizes the Released Parties and their agents to seek emergency medical treatment and transport for the Participant as deemed necessary. Participant acknowledges and agrees that they are solely responsible for the costs of any medical care or treatment incurred. Media Consent Participant grants permission to the Released Parties and their agents to use any photographs, videos, or other recordings taken during the Tournament for promotional, marketing, or other purposes without compensation. Binding Agreement This Release shall be binding upon the Participant and their heirs, executors, administrators, and assigns. The Participant affirms that they are of legal age (18 years or older) and have the legal capacity to execute this Release. Governing Law This Release shall be governed by and construed in accordance with the laws of the State of Illinois. Any legal action or proceeding under this Release shall be brought in the courts of McHenry County, Illinois. By signing below, Participant acknowledges that they have read and understood this Release of Liability, and agree to be bound by its terms. By signing this form, I agree to the above terms of release (or in the case of my minor child, I agree on behalf of my minor child).
